Several medical manufacturing companies””Johnson & Johnson, Boston Scientific, and C.R. Bard””have come under fire recently for producing and selling transvaginal mesh implants that can cause internal injuries, debilitating pain and a plethora of long-lasting health complications.
One such company, Johnson & Johnson, has agreed to pay over $120 million to settle nearly 3,000 lawsuits filed by women who claim its vaginal mesh devices shifted after being surgically implanted and caused severe pain, tears in the abdominal wall and internal bleeding.
The recent settlements mark the first time Johnson & Johnson has agreed to resolve a significant amount of mesh lawsuits. Previously, the company had only agreed to settle a handful of cases.
The company still faces an additional 42,400 lawsuits related to its vaginal mesh, yet it is unclear as to how Johnson & Johnson will approach the remaining cases. According to a report filed with the Securities and Exchange Commission, the company has set aside an undisclosed amount of money for its transvaginal mesh lawsuits and other defective product claims.
In 2012, the U.S. Food and Drug Administration (FDA) ordered Johnson & Johnson, as well as Boston Scientific and C.R. Bard, to conduct further safety tests on their vaginal mesh devices after the companies were hit with thousands of lawsuits.
The first transvaginal mesh lawsuit was filed in 2011 and has since grown to over 100,000 suits against several medical manufacturing companies. To date, Johnson & Johnson has faced the most lawsuits pertaining to defective mesh devices. However, Boston Scientific and C.R. Bard have also set aside more than $1 billion each to settle claims over their vaginal mesh devices.
Representatives from C.R. Bard said the company still faces 12,850 mesh lawsuits, after having settled nearly 6,400 cases. In August 2015, the company agreed to pay more than $200 million to resolve at least 3,000 vaginal mesh implant lawsuits.
