+ What Is the False Claims Act?

The False Claims Act, also known as the Qui Tam Statute or the Whistleblower Act, allows private citizens to file a lawsuit on behalf of the United States over fraud committed against the federal government.

If successful, the guilty party is generally required to repay the government triple the amount that was defrauded. Given the fact that the whistleblower or employee who filed the lawsuit faces significant personal risk by coming forward, they are entitled to 15 to 30 percent of the government’s reward. The False Claims Act now recovers approximately $3 billion each year nationwide.

Additionally, federal and state laws offer protection for whistleblowers who make claims against fraudulent organizations.

+ Types of Whistleblower Claims We Handle

Fraudulent acts can occur in any industry that enters into a governmental contract. Fraudulent activity that can lead to a Qui Tam lawsuit usually involves Social Security, Medicaid and Medicare, and defense contractor fraud; however, other types of fraud covered by the False Claims Act can include:

  • Health care
  • Taxes
  • Corporate fraud
  • Federal student loans
  • Government construction
  • General Services Administration (GSA)
  • US Postal Service
  • Environmental fraud
  • Federal crop insurance
  • Government contractors
  • US customs and shipping

At Phillips Law Group our Phoenix whistleblower attorneys understand that you may be apprehensive about coming forward; we can confidentially advise you on whether or not there is enough evidence to pursue a claim and if so, we can provide counsel on employment protection and the next steps you can take to pursue your claim.

+ Whistleblower Protection Against Wrongful Termination

Under federal and state law, you may not be retaliated against for reporting fraud or submitting a claim to the federal government.

Some forms of retaliation that your employer may not practice include (but is not limited to):

  • Job termination
  • Demoting the employee
  • Assigning the employee less appealing work
  • Giving negative job evaluations
  • Asking colleagues to shun the whistleblower

If an employer has retaliated against you for reporting illegal or dishonest conduct, you have legal rights and may be entitled to more compensation. Do not let your employer bully you; contact one of our experienced Phoenix whistleblower lawyers at Phillips Law Group today.
