Sunscreen Recall Lawsuit | Benzene

In July 2021, Johnson & Johnson recalled several aerosol sunscreen products because they contain benzene, a chemical that may cause cancer. This is a response to research done by Valisure; the independent pharmaceutical testing lab found 78 lots of sun care products made by several companies contained significant amounts of benzene.

Just two months later, one of these companies, Coppertone, announced a voluntary recall of several lots of aerosol sunscreen spray products. The company discovered the products contained Benzene.

Those who used benzene-containing sunscreen and were diagnosed with cancer may be able to take legal action against the manufacturer. How Could Sunscreen Cause Cancer?

When you apply sunscreen, the body absorbs it and chemicals from these products can enter your bloodstream. If the sunscreen you used contains benzene, you may be at risk for developing cancer, as benzene has been classified as a carcinogen.

While there are no studies specifically about cancer and benzene-containing sunscreens, we have known benzene is dangerous for more than a century.

    Why is Benzene Dangerous?

Organizations like the International Agency for Research on Cancer (IARC), the Environmental Protection Agency (EPA), and the Food and Drug Administration (FDA) have all classified benzene as a substance that is highly dangerous to human beings.

The IARC says benzene is carcinogenic to humans — carcinogenic means cancer-causing. The EPA classifies benzene as a human carcinogen and the FDA considers benzene to be a Class 1 solvent that should not be used when manufacturing drugs or drug products.

It is also important to note there is no safe level of exposure to benzene, as opposed to other substances that are dangerous only after high levels of exposure. This was the conclusion of Yale University’s Dr. Christopher Bunick, whose conclusion was cited by Valisure in its report on sunscreen brands tested for benzene. Bunick is an Associate Professor of Dermatology.

The Centers for Disease Control and Prevention has found that long-term exposure to benzene may increase the risk of developing various forms of cancer, such as:

    • Acute lymphocytic leukemia
    • Acute myeloid leukemia
    • Chronic lymphocytic leukemia
    • Multiple myeloma
    • Myelodysplastic syndrome
    • Non-Hodgkin’s lymphoma

    Symptoms of Leukemia

If you used a sunscreen product that was found to contain benzene, you could suffer a variety of side effects, including:

    • Fever
    • Chills
    • Vomiting
    • Tremors
    • Headaches

    Common symptoms of leukemia include:

    • Fatigue
    • Severe infections
    • Night sweats
    • Bleeding easily
    • Pain or tenderness in your bones
    • Weight loss that was unintended
    • Nosebleeds

If you are experiencing any of these symptoms, get to a doctor right away so he or she can determine what is going on. If you have leukemia, it is important to catch it as early as possible, because early detection may expand your treatment options and improve your long-term prognosis.

If you have reason to believe your health issues are connected to your use of benzene-containing sunscreen, including one of the products recalled by Johnson & Johnson, call Phillips Law Group today to discuss a potential sunscreen recall lawsuit.

One of our experienced defective product lawyers can determine your eligibility for a lawsuit, based on your diagnosis, history of sunscreen use, and evidence you have collected (used sunscreen bottles, receipts, etc.).

Coppertone has notified retailers to arrange for returns of these recalled items.

Valisure’s research on nearly 300 batches of products found that these popular sunscreen brands have products that contain benzene:

    • Aveeno
    • Coppertone
    • Banana Boat
    • Sun Bum
    • CVS Health
    • Walgreens
    • Fruit of the Earth
    • SunBurnt
    • LaRoche-Posay
    • Goodsense
    • Solimo
    • Equate
    • TopCare
    • Everyday
    • EltaMD
    • Babyganics
    • Max Block
    • Up & Up
    • Raw Elements

Valisure found that 14 products from these companies had benzene levels above two parts per million. There were also 26 products that had benzene levels between 0.1 parts per million and two parts per million. It is important to note serious health consequences could result from using sunscreen with benzene levels as low as 0.1 parts per million.

Valisure noted that the sunscreen products that were tested did not list benzene as an active ingredient. That is why Valisure concluded these products must have been contaminated somehow. Johnson & Johnson and Coppertone both said the recalls were being done out of an abundance of caution. Johnson & Johnson also said benzene is not an ingredient in any of their sunscreen products.

Have a question about a potential case?

    Is Oxybenzone Dangerous?

Many sunscreens contain oxybenzone as an active ingredient. While the FDA claims this chemical is safe, concerns have been raised about potential side effects.

For example, The Environmental Working Group says this is the “most worrisome” active ingredient in sunscreen. Research has found oxybenzone may cause skin allergies and disrupt normal hormone functioning. This chemical may be more harmful to children than adults.

The National Toxicology Program studied the effects of oxybenzone on rats and found strong evidence of carcinogenic activity. Starting in 2021, the state of Hawaii has banned sunscreens that contain this chemical over concerns it may damage coral reefs.

Have Any Lawsuits Been Filed Yet?

There is a class-action lawsuit in the Southern District of Florida alleging Johnson & Johnson violated state and federal laws when it failed to disclose the presence of benzene in sunscreen products.

There is also a lawsuit in the Northern District of California that seeks damages for consumers who purchased products that have been recalled.

There may be many more lawsuits filed in the coming months. It remains to be seen what allegations these lawsuits will make, but they may claim:

    • Selling dangerous products
    • Marketing products as safe even though they were not
    • Knowing these products were defective and cancer-causing
