Will Lyft’s Insurance Policy Cover Your Medical Bills?
Since rideshare companies are a relatively new concept, you may be unsure how to recover compensation after being injured in an accident involving a Lyft. The party responsible for your medical bills and other losses will likely depend on how the driver was using the Lyft app at the time of the accident.
When the Lyft driver was not logged into the app:
Lyft drivers are classified as independent contractors, not company employees. If the rideshare driver was “off duty” and not logged into the app, Lyft will deny all liability for the accident.
However, like all other motorists, Lyft drivers are required to have car insurance coverage. Accident victims can file a claim under their driver’s auto insurance policy or the driver themselves. If you have car insurance, you may also be able to file a claim with your insurers.
When the Lyft driver was logged in but had not accepted a ride request:
If the driver was logged into the app and awaiting a ride request when the accident occurred, you may be able to recover compensation under Lyft’s liability insurance policy.
Lyft’s liability insurance generally covers:
- Property damage: $25,000 per accident
- Bodily injury or death: $50,000 per person $100,000 per accident
However, their coverage information also includes the following exception: “Except covered accidents occurring in Arizona and Nebraska; where the third-party liability insurance is $25,000/per person for bodily injury; $50,000/accident for bodily injury and $20,000/accident for property damage; consistent with state requirements.”
Keep in mind that Lyft’s liability insurance is considered secondary coverage. This means you first have to pursue compensation through your driver and/or an insurance policy. If your damages exceed what you can recover from them, you can then file a claim with Lyft’s insurance policy.
When the Lyft driver was logged into the app and had accepted a ride request:
Once a Lyft driver accepts a ride request, Lyft’s $1 million insurance policy goes into effect. The policy will cover a passenger for injuries and property damage from the moment he or she is picked up until finally dropped off at the destination.
