More Information on Workers’ Compensation
Workers’ Compensation Overview
Workers’ compensation was one of the first forms of social insurance in the United States. As a means of protection for both employers and employees, all states, including Arizona and California, work with the federal government to provide injured workers with financial assistance after an on-the-job injury or illness.
The main objectives of workers’ compensation in Arizona include:
- Providing cash benefits and medical care to employees who have suffered work-related injury or illness
- Providing survivor benefits to those dependents of workers whose injury resulted in death
Collecting workers’ compensation payments is often not as simple as filling out the correct forms. But your employer, or your employer’s insurance company, may look for ways to avoid paying your claim.
For example, your employer or their insurance company may argue that your injury was actually caused outside of working hours, or that your own conduct caused the accident. If this is the case, it may be more difficult to get your claim approved.
Phillips Law Group handles workers’ compensation claims, as well as other Arizona employment law cases including wage and hour claims. With years of experience, a workers’ compensation attorney will work with you and your insurance company to recover the payments to which you are entitled.
If you or a loved one has been injured on the job, report the injury as soon as possible. According to Arizona law, your employer must be notified about the accident and/or job-related injury within 30 days of its occurrence. In addition, your employer must notify its insurance company and arrange for your medical care.

Disability Benefits
If your on-the-job injury results in a disability (whether permanent or temporary), you will receive either weekly or monthly benefits while your disability exists, or a lump-sum payment for your permanent impairment.
The amount of money you will receive for your workers’ compensation benefits will depend on how your injury is classified. Your doctor will rate your level of impairment, and determine if you will be impaired permanently or on a temporary basis. How you are rated will determine the types of benefits you will receive.
Dependent upon your injury, the following types of disability benefits may apply to your injury:
- Permanent Impairment Benefits: payments for permanent disabilities, like blindness, loss of limbs or digits, or disfigurement.
- Permanent Total Benefits: payments made to people who are permanently and completely disabled, so much so that they can never return to work.
- Supplemental Benefits: payment for disability with an impairment rating of 20 percent or higher. In this regard, the employee either returned to work earning less than the pre-injury income or the employee cannot yet return to work and cannot find an appropriate job.
- Temporary Partial Benefits: payments for disability where an employee continues to work, on a limited basis, during recovery.
- Temporary Total Benefits: the payments associated with an employee who is prevented from working for a temporary period of time prior to achieving full medical progress.
- Death Benefits: payments collected by the surviving dependents if an employee dies as a result of an accident within 1 year, or an accident occurring within 5 years if a continuous disability is present.
Understanding the appropriate and available disability benefits is essential to your case. A workers’ compensation attorney from Phillips Law Group will walk you through each step in this process.
